PROMOTER

All Milwaukee redemption offers are run by Techtronic Industries N.Z. Limited trading as Milwaukee Tool New Zealand (NZBN 9 429 039 761 347) of 274 Church Street, Onehunga, Auckland 1061, New Zealand (Promoter).

 

WHO IS ELIGIBLE TO PARCTIPATE

A Redemption Offer is only open to Eligible Persons. An Eligible Person is a person who:

  1. is either an New  Zealand citizen or a resident;
  2. is over the age of 18 years or a parent or guardian of a person who is under the age of 18 years;
  3. during the Promotion Period purchases an Eligible Product from an Authorised Milwaukee Retail Partner in New Zealand;
  4. submits a valid Redemption Claim before the Redemption Claims End Date;
  5. provides a physical New Zealand street address for the distribution of the redemption (PO Boxes are not acceptable);
  6. in the reasonable opinion of the Promoter, is claiming the redemption exclusively for the Eligible Person’s own personal use or as an authorised person claiming on behalf of their employer as a corporate purchase and is not claiming either (i) for any other commercial purpose such as for the resale of an Eligible Product or a Redemption Offer, or (ii) on behalf of any other person or group of persons (including persons based at the same physical street address);
  7. does not in any way tamper, or attempt to tamper, with the redemption and/or the claim process for the redemption (including by submitting fraudulent claims for redemption) and/or does not engage or attempt to engage in any behaviours which are inconsistent with these Terms and Conditions;
  8. has not previously been denied a redemption claim by the Promoter for reasons associated with a reasonable suspicion of tampering or attempted tampering with the redemptions process and/or for a reasonable suspicion of non-compliance with these Terms and Conditions; and
  9. otherwise fully complies in all respects with these Terms and Conditions.

 

PROMOTION PERIOD

A Redemption Offer shall be available for purchases of Eligible Products made during any periods listed on https://www.milwaukeetool.co.nz/redemptions/ (Website) and/or on any applicable marketing material or point of sale published by or on behalf of the Promoter communicating the redemption offer, including in store point of sale (Point of Sale).

Where there is a difference between the Promotion Period listed on the Website and the Promotion Period listed on Point of Sale, the Promotion Period listed on the Website shall prevail.

 

ELIGIBLE PRODUCT(S)

Milwaukee products which are eligible to obtain a Redemption Offer shall be listed on the Website and/or on Point of Sale.

If a bundle of Milwaukee products is listed as an Eligible Product (such as a “Kit” or “Power Pack”) then that entire bundle must be purchased in the full and entire original listed composition. Individual items or products within the listed bundle cannot be swapped, changed or altered in any manner whatsoever otherwise the bundle will be immediately and automatically deemed to be excluded from being an Eligible Product.

If an Eligible Product requires the purchase of multiple products that are not otherwise sold as part of a Kit or Power Pack, all of those products must be purchased in a single transaction and appear on the same Proof of Purchase.

Certain Milwaukee products may also be specifically excluded from being an Eligible Product. These may be listed on the Website or on Point of Sale.

Milwaukee products which have been purchased as part of, or used in conjunction with, any other bonus offer or redemption offer made available by the Promoter or any Authorised Milwaukee Retail Partner whether during or outside of the Promotion Period may be excluded from being Eligible Products, at the Promoter’s discretion.

In addition, the following Milwaukee products shall always be deemed to be excluded from being Eligible Products notwithstanding anything listed on the Website or Point of Sale:

  1. Milwaukee products which would have been Eligible Products but were purchased outside of the Promotion Period;
  2. Milwaukee products which were purchased outside of New Zealand;
  3. Milwaukee products which were purchased from:
    1. any retailer who is not an Authorised Milwaukee Retail Partner;
    2. any online marketplace; or
    3. any person who has originally purchased the Milwaukee product from an Authorised Milwaukee Retail Partner but who subsequently on sells that Milwaukee product; and
  4. Milwaukee products which have not been purchased in their original packaging (for example, products that are sold individually after being removed from a broader Milwaukee product kit).

If an Eligible Product is returned to its place of purchase, the corresponding Redemption Claim will be deemed to be immediately invalid. If the Eligible Product is returned after a Redemption Offer has been delivered, the Promoter may refuse to accept any further Redemption Claims from that Eligible Person for any period thereafter (in its absolute discretion).

If an Eligible Product is replaced by an Authorised Milwaukee Retail Partner due to a product quality issue, the Promoter may request that a new Redemption Claim must be submitted including the replacement documentation as Proof of Purchase.

Where there is any difference between the Eligible Products listed on the Website and the Eligible Products listed on Point of Sale, the Eligible Products listed on the Website shall prevail.

 

REDEMPTION CLAIMS END DATE

A valid and fully completed Redemption Claim for a Redemption Offer must be received by the Promoter by the date which is listed on the Website and/or on Point of Sale as the date of closing for the applicable redemption submissions to be made.

Any claims received by the Promoter after the Redemption Claims End Date shall be ineligible for a Redemption Offer. The Promoter takes no responsibility for any Redemption Claims that are late, lost, misdirected or for whatever other reason are not received by the Promoter by the Redemption Claims End Date.

Where there is any difference between the Redemption Claims End Date listed on the Website and the Redemption Claims End Date listed on Point of Sale, the Redemption Claims End Date listed on the Website shall prevail.

 

REDEMPTION OFFER

The Milwaukee product(s) which can be redeemed as a redemption in reward for purchasing an Eligible Product shall be listed on the Website and/or on Point of Sale in respect of each Eligible Product.

A Redemption Offer can only ever be claimed from the Promoter by submitting an online Redemption Claim via a Milwaukee Account accessible on the Website. Redemption Offers will never be provided by Authorised Milwaukee Retail Partners at the point of purchase in store.

A Redemption Offer cannot be returned to the Promoter or any Authorised Milwaukee Retail Partner, is not transferable or exchangeable for any other Milwaukee product and cannot be redeemed as cash.

Where there is any difference between the Redemption Offer listed on the Website and the Redemption Offer listed on Point of Sale, the Redemption Offer listed on the Website shall prevail.

 

LIMITED REDEMPTION OFFERS

The Website and/or on Point of Sale may state that a Redemption Offer for a particular Eligible Product will be capped at a limited total amount (Redemptions Cap).

Where a Redemptions Cap applies, any claims made after Redemptions Cap has been reached shall be ineligible for the Redemption Offer and the Promoter may reject such claims. Alternatively, where a Redemptions Cap is reached, the Promoter may (in its absolute discretion and without any obligation) elect to provide substitute Milwaukee product(s) of a similar type or similar value to the applicable Redemption Offer as determined by the Promoter (in its absolute discretion).

 

MULTIPLE REDEMPTION CLAIMS

Unless other conditions are specified on the Website or Point of Sale which restrict the number of Redemption Claims for an Eligible Product (including where a Redemptions Cap applies), an Eligible Person is permitted to submit multiple Redemption Claims for the purchase of multiple Eligible Products, subject to complying with the following:

  1. Only one (1) Redemption Claim is permitted for the purchase of each Eligible Product.
  2. An Eligible Person can only submit valid Redemption Claims up to the Maximum Redemption Claims Limit defined in Table 1 across all purchases of all Eligible Products for the applicable Promotion. If more Redemption Claims than the Maximum Redemption Claims Limit are received, the Promoter will determine (in its absolute discretion) which Redemption Claims will be accepted and which Redemption Claims will be rejected from across all Redemption Claims submitted by the Eligible Person up to the Maximum Redemption Claims Limit.

By way of example, if no other conditions restrict the number of Redemption Claims for a specific Eligible Product and the Maximum Redemption Claims Limit defined in Table 1 for that Promotion is five (5), then:

  1. Each Redemption Claim must be submitted separately and at all times fully comply with these Terms and Conditions.

Where other conditions are specified on the Website or Point of Sale which limit the number of Redemption Claims for an Eligible Product (including where a Redemptions Cap applies), those conditions and limitations shall prevail over the above.

 

PROOF OF PURCHASE

All Redemption Claims for a Redemption Offer must be supported by a valid and original proof of purchase document issued by the Authorised Milwaukee Retail Partner from whom the Eligible Product was purchased. Proof of Purchase documents must not be shared by persons.

The Promoter reserves the right (in its absolute discretion) to request further information (including as to the circumstances surrounding the purchase) and/or to invalidate a claim for a Redemption Offer and/or to invalidate multiple claims by the same person for multiple Redemption Offers if it considers that adequate or original Proof of Purchase has not been provided or that Proof of Purchase has been submitted fraudulently. Failure to respond to such a request within a reasonable time period (as determined by the Promoter in its absolute discretion) shall entitle the Promoter to reject a Redemption Claim.

 

HOW TO SUBMIT A REDEMPTION CLAIM

To make a Redemption Claim for a Redemption Offer, an Eligible Person must:

  1. during the Promotion Period, purchase an Eligible Product from an Authorised Milwaukee Retail Partner in New Zealand and retain the original Proof of Purchase;
  2. before the Redemption Claims End Date (or before the Redemptions Cap is reached for any Limited Redemption Offers):
    1. go to https://accounts.milwaukeetool.co.nz/s/redemptions and log in to the Eligible Person’s Milwaukee account (if an Eligible Person does not have a Milwaukee account, they will need to register for one first);
    2. fully complete the Redemption Form, including by providing all required personal information about the Eligible Person (full name, contact number, email address and New Zealand street address) as well as all required details of the Eligible Product purchased;
    3. upload the original Proof of Purchase; and
    4. submit the fully completed Redemption Form.

Redemption Claims will not be accepted by the Promoter in any other form unless otherwise provided on the Website or Point of Sale.

  1. Individually and personally complete and submit their own Redemption Form and not have the Redemption Form completed or submitted by any third party (such as an Authorised Milwaukee Retail Partner).
  2. Once an Eligible Person has submitted a Redemption Form:
    1. they will receive an email notification confirming their application for a Redemption Offer has been submitted;
    2. their application for a Redemption Offer will then be verified by a Milwaukee staff member; and
    3. in due course they will be notified if their application has been successful, rejected or if further information is required in order to properly assess the application.

Any Redemption Claim that fails to provide complete, true or correct information will be deemed invalid and the Redemption Claim will be rejected in the Promoter’s absolute discretion.

The Promoter reserves its right to request such further information as it considers necessary to validate a Redemption Claim (or any information provided in a Redemption Form) and failure to respond to such a request within a reasonable time period (as determined by the Promoter in its absolute discretion) shall entitle the Promoter to reject a Redemption Claim. Suitable forms of verification are at the discretion of the Promoter.

Where the Promoter considers it necessary to request further information from Authorised Milwaukee Retail Partners in order to verify or validate a Redemption Claim, it may do so in its discretion and the Authorised Milwaukee Retail Partner may provide such information to the Promoter in response to such requests.

 

DELIVERY

Once a Redemption Claim has been validated by the Promoter as being fully eligible for a Redemption Offer, the Promoter shall arrange for delivery of the Redemption Offer to the Eligible Person. It is generally expected that it may take up to six (6) weeks for delivery, however that period may change depending on the circumstances applicable at the time.

Delivery will only ever be made to a physical street address in New Zealand nominated by the Eligible Person. Deliveries will not be made to a PO Box. Deliveries will require a signature of acceptance, and the Eligible Person is responsible for making sure they (or a nominated representative) are available to accept delivery.

Proof of delivery by the Promoter’s delivery partner will be deemed conclusive evidence of acceptance and fulfilment of the Redemption Offer and no correspondence will be entered into regarding lost items where proof of delivery has been provided. The Promoter takes no responsibility for any incorrect delivery address details submitted in a Claim Form.

 

CORPORATE PURCHASES

If an Eligible Product is purchased on behalf of, or by using funds provided by, a corporate entity (for example, by an employee of an organisation using their employer’s corporate credit card) (Corporation), the Eligible Person represents and warrants that they have the full approval and authority from the Corporation to make the Eligible Purchase and submit the Redemption Claim. The Eligible Person further represents and warrants that they will use and apply the Redemption Offer fully in accordance with all policies and requirements of that Corporation.

The Promoter takes no responsibility for any Redemption Claims made by an Eligible Person in breach of any Corporation’s policies or requirements. By submitting a Redemption Claim, the Eligible Person expressly consents to the Promoter disclosing any details regarding the Redemption Claim to the relevant Corporation to the extent necessary to either validate a Redemption Claim or in response to any requests for information from the Corporation. The information that the Promoter may provide may include (but is not limited to) personal information about the Eligible Person, copies of any Proof of Purchase, details of any Redemption Offers that have been redeemed and delivery details for any Redemption Offer.

 

GENERAL CONDITIONS

  1. These Terms and Conditions incorporate and must be read together with the details outlined above as well as any information set out on the Website or Point of Sale. Information about the Redemption Offer and how to claim (including on the Website or Point of Sale) forms part of these Terms and Conditions.
  2. A person is deemed to have accepted these Terms and Conditions by submitting a Redemption Claim. No other terms or conditions (including any terms or conditions from any Authorised Milwaukee Retail Partners) shall apply.
  3. No employee, agent or representative of the Promoter is authorised to make guarantees, warranties or representations in addition to, or contrary to, these Terms and Conditions.
  4. The Promoter reserves the right to exclude a Redemption Claim made by employees and family members, of the Promoter, Authorised Milwaukee Retail Partners or any third parties involved in administering a Redemption Claim where the Promoter reasonably considers that the Eligible Purchase used to submit a Redemption Claim has been made using any employee or staff discount that may be available to that person.
  5. The person submitting a Redemption Claim represents and warrants that all information provided is true, correct and accurate. Any misrepresentation or fraudulent information supplied in connection with a Redemption Claim will immediately disqualify the Redemption Claim and that person may be ineligible for any future Redemption Claims (in the Promoter’s absolute discretion). Any Redemption Claims submitted by a person who is suspected of tampering or interfering with the redemption claim process will be immediately disqualified and that person may be ineligible for any future Redemption Claims (in the Promoter’s absolute discretion).
  6. All Redemption Claims are for personal use only and must not be resold. Without limiting any other rights, the Promoter reserves its right to immediately cancel or reject any Redemption Claim if the Promoter reasonably suspects that an Eligible Product has been purchased, or a Redemption Offer has been claimed, with the intent of that Eligible Product or Redemption Offer being resold by the person submitting the Redemption Claim (either directly or through a business in which that person is involved).
  7. Authorised Milwaukee Retail Partners are unrelated and independent third parties. Any values of Eligible Products or Redemption Offers stated by the Promoter are based on the recommended retail price (RRP) of those products. However, each Authorised Milwaukee Retail Partner is free to determine the actual retail price of those products at their absolute discretion so actual values may vary. Eligible Products may not always be available in all Authorised Milwaukee Retail Partner stores during the entire Promotion Period. Rainchecks or future order confirmations will not be accepted by the Promoter as Proof of Purchase for a Redemption Offer.
  8. Where multiple Redemption Offers are available for selection in respect of a particular Eligible Product, the availability and delivery times of the chosen Redemption Offer may be impacted depending on the overall demand for those Redemption Offers.
  9. Whilst the Promoter takes reasonable efforts to ensure stock of Redemption Offers is sufficient to meet anticipated demand for Redemption Claims, circumstances beyond the Promoter’s reasonable control can mean that a Redemption Offer may not be available (including due to overwhelming demand, supply chain issues or other circumstance beyond the Promoter’s control). If the Promoter is unable to provide the specific Redemption Offer, the Promoter will instead make available to an Eligible Person the choice of waiting until replenishment stock of the specific Redemption Offer becomes available or receiving alternative Milwaukee product(s) of similar style or similar value (in the Promoter’s absolute discretion) by way of substitution.
  10. The time taken to verify a Redemption Claim, the availability of a Redemption Offer and the date for receiving delivery of a Redemption Offer may all be impacted due to reasons outside the control of the Promoter and without notice to an Eligible Person.
  11. There is no fee charged to make a Redemption Claim other than the cost of purchasing an Eligible Product and accessing the Internet to submit the claim.
  12. If a Redemption Offer cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel any Eligible Product, any Redemption Offer, the Redemption Period, the Redemption Claims End Date or any other conditions relating to the Milwaukee redemption program or disqualify affected Redemption Claims / Claimants.
  13. If a Redemption Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties or electronic tampering or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Person, or (b) to modify, suspend, terminate or cancel the redemption offer, as appropriate.
  14. The Promoter takes no responsibility for any technical malfunctions or problems with internet or network congestion, problems with transmission of entries and / or emails over the internet, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.
  15. Any taxes which may be payable as a consequence of an Eligible Person receiving a Redemption Offer are the sole responsibility of the Eligible Person.
  16. If any dispute arises between the Promoter and any person submitting a Redemption Claim concerning any matter related to these Terms and Conditions or the redemption process, the Promoter will take reasonable steps to consider that person’s point of view, considering any facts or evidence put forward, and to respond fairly and within a reasonable time. In all other respects, the Promoter’s decision is final and no correspondence will be entered into.
  17. The Promoter collects personal information ("PI") in order to administer this promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and related entities of the Promoter. Some of these third parties are located outside Australia and New Zealand and may not protect your PI in a way that, overall, provides comparable safeguards to Australian and New Zealand privacy laws. By entering this promotion a Person is consenting to the disclosure of a Person’s PI to entities outside of Australia and New Zealand. For further information, please see the Promoter’s Privacy Policy which can be viewed at https://www.milwaukeetool.co.nz/privacy-policy.html. Entry into the promotion may be conditional on providing certain PI. The Promoter will also use and handle all PI as set out in the Promoter’s Privacy Policy. In addition to any use that may be outlined in these Terms and Conditions and the Promoter’s Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research, survey and profiling purposes, including sending emails/electronic messages, SMS or telephoning a person. The Promoter’s Privacy Policy also contains information about how a person may opt out of any communication, access, update or correct their PI, how a person may complain about a privacy breach or concern and how those complaints will be dealt with.
  18. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993 (NZ) and Fair Trading Act 1986 (NZ) or any other implied warranties that are incapable of being excluded (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of any Redemption Claim.Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

  20. The laws of New Zealand apply to this redemption to the exclusion of any other law. Persons submit to the exclusive jurisdiction of the courts of New Zealand.
